Dan Bernath was my attorney. Dan Bernath worked his tail off for me and my wife and I really appreciate all he has done for us.

I was very pleased and grateful to Dan Bernath because he did a wonderful job for us.

The old lawyer was Merrill Schneider and I fired him. I fired him because he went past a deadline and I had to notify him two or three different times. He finally got it figured out but we were close to having start all over again!

Dan kept me informed. Dan  worked hard to get me my benefits early.  That is something that Schneider would not have done.

After researching your background with my husband, I truly feel that I now have a chance to not only live to see my children grow up, but to gain the resources and acceptance I need to have a semi-livable quality of life.

Fired Schneider-Hired Bernath

I never met with or spoke with attorney Merrill Schneider. I saw his advertisement on the television and he said “Free Consultation.” He can’t charge me now for what his advertisement then said was “free.”

I set up an appointment with my friend R and myself to meet with Merrill Schneider.  We met at his office and met with Nicole Schneider. I was with her for 30 minutes-the free consultation he advertises.  I never heard from Nicole Schneider or Merrill Schneider, again. I never heard from anyone at his office.  I called him at least once a month. They were always never in the office. The receptionist said, “can I have your name and number and they’ll call you back” but no one ever called me back and I called them once a month.

I hired Schneider so that he would look into my case. When I first met with Nicole and I told her that Victims Services of Oregon paid me for a whole year and she said, “then your case is a slam dunk.”  I thought that he and she would then do an OTR-that is, get the case decided in my favor without me having to wait for a hearing because it was so obvious that I was disabled. That’s what Nicole Schneider said-it was a “slam dunk.:”

I believed he and she would work on that but they did nothing and my case just sat on his shelf. I now find that he did not obtain any of my medical records and it appears to be negligence that they did not get me my benefits by just getting my medical records and showing them to a judge (an OTR) without making me wait for a hearing.  When I fired Schneider and I said I wanted my medical records, he replied that he didn’t have ANY medical records. So all that time I thought he was working on my case but it was just sitting on a shelf collecting dust at his office.

When I hired Dan Bernath as my lawyer, I noticed a big difference. I spoke with Bernath all the time, he kept me informed about everything. He answered his phone personally and didn’t use a secretary or receptionist to hide behind. Bernath got me a hearing in five months.  Schneider did not send me any letters to tell me what was going on filing papers, how to get things done, how to prepare- he didn’t send me squat.

Bernath did real good in preparing the case for trial. I got paperwork on how to get medical records, how the whole disability thing works at Social Security court, how I can best testify to show the judge my condition and had many discussions with Bernath on strategy, how to handle myself at the hearing and what was expected to win benefits.

I knew I didn’t have to worry because Bernath was working on my behalf day after day.  I really was impressed at how attorney Bernath pulled every detail of my medical problems out of me in testimony. Bernath said at the hearing that “Judge Jones runs a tight ship” and still I watched Bernath get it all on the record, quickly and professionally. When I got emotional at one point in the hearing or when I didn’t quite answer a question, Bernath was very good at politely and quickly getting me back on track.

Bernath did a very good job in cross examining the vocational expert in that the last thing said in the hearing was that I was disabled and could not work. I thought that was a good thing that Bernath did that in having the vocational expert say that as the last thing said at the hearing for the judge to hear.

Attorney Bernath has changed my life.
