Before I hired Daniel Alan Bernath as my disability lawyer, I had another lawyer David Lowry who lost the case.
Honestly, my first hint of a problem with my
claim was at the hearing (after waiting for years). The judge was hostile
toward both me and David Lowry
and myself and there were absolutely no efforts by my attorney to challenge
anything
in the hearing
whatsoever. I honestly felt from his appearance (wearing tennis shoes
with his suit, shoelaces untied and wrinkled suit) that maybe he was trying
some kind of courtroom stunt as he sure hadn't looked like that in his office.
(I had one meeting with him personally before the hearing). After the hearing he literally said goodbye and left me standing there with my family with no further comment.
My second clue of disaster was the decision
itself. It took over 4 months to receive the decision. The decision could not
have been further from the truth as far as reflecting an accurate understanding
of my life and condition. My feeling was that if the court's
perception of my situation was so off-base, why would my attorney David Lowry not have
suggested [[prior to court]] that there might be a problem. At no time had
my attorney suggested a problem with anything in my case whatsoever.
After the hearing I wrote David Lowry a letter and expressed my concerns. As of this date, 3 months later, he still avoids discussion of problems with the previous claim, my letter, or how to prepare better for a future claim. (So, I fired him.)

We do not make inquiries into the quality of a
lawyer's services.
A lawyer whose conduct falls below the standard of care in the community may be liable to the client for legal malpractice. If Ms. F feels that she has a legal malpractice claim against David B. Lowry, she may want to contact another attorney to explore what remedies are available. Ms. F or her new attorney may also want to contact the Professional Liability Fund.

ph my god, this is my SSI lawyer, no wonder I haven't gotten anywhere in the 6 years he has represented me and I have had a "unsucessful" back surgery and a car accident since I first became disabled and the man has not gotten me a dime of SSI or SSD, the State of Oregons welfare department has been supporting me. Oh my God!!! now what?
