The California State Bar has investigated the complaint from the Oregon State Bar and has stated that attorney Daniel Bernath has every right to practice law before federal agencies in Oregon (as he does in all other states and territories of the United States)
The California Bar has taken the Oregon State Bar complaint, investigated it again and has again stated that Bernath has violated no ethical rules, now or in the past. In other words, the California Bar is saying that the Oregon Bar lied and the Oregon Supreme Court merely rubber stamped the lie.
(The US Supreme Court has laid down this principle over 45 years ago. Sperry v. Florida 373 U.S. 379 (1963)

I am in receipt of your letter dated October 17, 2006 and note its contents.
The reason you are receiving so many complaints from Oregon [and the Oregon State Bar] is because of a campaign by unhappy lawyers who practice law before the federal Social Security Administration that I have such a large and fast growing clientele in serving United States Social Security Administration disability claimants in California, Oregon and Washington State. Regrettably, the Oregon State Bar has repeatedly lied to you.
At paragraph two you note that the Oregon State Bar alleges, “you offer services in Oregon as an attorney specializing in Social Security matters, your web site implies you are admitted to practice in Oregon.”
This false. A review of my website clearly states, “
I do all the legal work on your Social Security Disability case personally. An experienced attorney at law-not a secretary or a so called "para-legal." Talk to me, the attorney, at any time.The subsequent page states: “What I will do; represent you for a disability claim before the Social Security Administration.
What I will do; represent you for a disability claim before the Social Security Administration at any field office, including Beaverton Oregon, Astoria, Oregon, Pendleton, Oregon, Salem, Oregon, Gresham Oregon, Portland Oregon and at the Social Security Office of Hearings and Appeals at Portland, Oregon, Salem, Oregon, Astoria, Oregon, Pendleton, Oregon, or Seattle, Washington, Tacoma, Washington, Vancouver, Washington or any Social Security office in the states of
Oregon, Washington, California or any other Social Security office in the United States or its territories.Represent you before any Court of the State of California.

This website resides on a server in the State of Connecticut (not Oregon) and is viewed by people in all 50 states because I practice Social Security law in all 50 states.
“…your ad implies you are an Oregon attorney,”
This is false. I am an active member of the California Bar, the U.S. Supreme Court Bar, the United States District Court for the Southern District of California and the United States 9th Circuit Court of Appeals. As such, I am entitled to practice law before the Social Security Administration as an attorney at law, counselor and lawyer in all 50 states. My ad states this truthfully.
“…clients that hire you believe you are an Oregon attorney.”
That is false. No client has hired me believing I am licensed by the Oregon State Bar. I have had or currently have or potentially have clients in California, Washington State, Pennsylvania, Georgia and Oregon before the United States Social Security Administration. If any Oregon client asks me a question other than United States Social Security law or regulation or United States immigration law or regulation I tell them that I am not an lawyer licensed for Oregon State matters and give them the telephone number for the Oregon State Bar at 503.620.0222. I also do this when I get a Washington client asking about Washington State Court matters; I tell them to call the Washington State Bar referral service.“Ms Lowry…alleges you solicited her by phone…it appears you held yourself out to be an Oregon attorney when you made the solicitation.”
That is false. Telephone records show the following.
April 23, 2006, Lowry called me at 2:51 pm and left a one minute message.
April 24, 2006 I telephoned Lowry at 8:53 a.m. and left a message.
April 24, 2006 Lowry telephoned me and we spoke for a total of 26 minutes. She hired me as her Social Security attorney and I sent her a letter.
May 9, 2006 I telephone her at 4:17 pm because she did not follow through on executing the written agreement.
May 9, 2006 Lowry telephones me and told me that she has hired another attorney.
The letter to Lowry appears to some sort of “sting” attempt by the Oregon Bar and it riddled with falsehoods. Indeed, the letter I mailed to her clearly states this:

I never wrote an article on Craig’s list which she falsely states.
The Oregon State Bar is incorrect in stating that a California attorney at law cannot call himself an attorney at law if he practices Social Security law. The US Supreme Court long ago has firmly stated that any state law is preempted by Social Security regulation regarding the practicing of law before the United States Social Security Administration and Social Security is not preempted by the various conflicting laws of the 50 state jurisdictions. Sperry v. State of Florida 373 US 379 (1963).
Indeed, there are scores of attorneys who are licensed in Washington State who practice Social Security law in Portland Oregon and throughout Oregon. These Washington State attorneys are not as successful as attracting clients and therefore there is no campaign by the Oregon lawyers by and through their Oregon Bar Association against them. Likewise there are California licensed attorneys who practice United States immigration law in Portland Oregon who are not attacked by the Oregon lawyers through their bar association. Furthermore, there are New York State lawyers, (e.g. Binder and Binder for example) of New York State who actively practice and actively advertise in Oregon for Social Security clients who are not attacked by the Oregon State Bar because they are not as successful as serving and attracting these clients. There are also other California lawyers who practice Social Security law in Oregon but as they are not as successful in attracting clients are not under attack by the Oregon lawyers by and through their Oregon State Bar (Fleming of Los Angeles). It is a very common thing and protected by the United States Constitution. Sperry v. State of Florida 373 US 379 (1963).
The Oregon State Bar has singled me out because I am exercising my rights to practice Social Security law in California, Oregon and Washington State and because of the prompt and successful service I provide that has caused these clients to hire me and not hire less desirable members of the Oregon bar.
Karen Valdez “The Oregon State Bar alleges you may have engaged in the unlawful practice of law by representing Ms. Lopez in a Social Security Appeal.”
Again, the allegation by an Oregon lawyer who was fired for his malpractice against Valdez and forwarded to you by the Oregon Bar is totally false. There is no appeal by Ms. Valdez (you incorrectly call her Lopez in your letter at paragraph 3).

I am in receipt of your letter dated August 10, 2006. [An investigation triggered by an Oregon State Bar complaint to the California State Bar] You are requesting that I answer for events that occurred around 1994-about 12 years ago. Indeed, at least one of the charges by the California State Bar was made, investigated and dropped over a decade ago [because the complainant was proved to be lying].
You have requested a written response to certain allegations along with any supporting documentation.
Allegation 1
You lied to the Oregon Board about your status with the State Bar of California stating you weren’t suspended when in fact you were.
Response:
I did not lie to the Oregon Board. I stated truthfully in my application that I was an attorney at law, licensed by the California State Bar. I was asked in Part III of their application, “List the states or countries where you have been admitted to practice law an the date your were admitted to each jurisdiction.”
I correctly stated, California. I further stated in an attachment “There was no termination of my practice.” Application was made October 1994.
A review of my Status History with the California Bar shows that at the time of my application with the Oregon Bar (approximately October 1994) I was an active member of the California Bar when in January 1, 1995, I voluntarily went on inactive status (because I wasn't representing clients at that time).
At no time did I lie to the Oregon Bar. I never stated I was not suspended when I was suspended. I never stated that I could practice law at a time when I could not practice law. My status of having an inactive license to practice began 1/1/1995 and continued to 8/6/97. The charge is false and doesn’t even sound reasonable as a simple telephone call to the California Bar at any time will reveal the status of a California attorney, including myself.
Allegation 2
You lied to the Oregon Board with respect to your former client Tamara Varner, when you told them you didn’t notarize her settlement documents;
Response:
I never lied to the Oregon Board. Even the Oregon decision doesn’t say that. It says, “He lied by omission to the Board when he told it that he did not notarize the Varner settlement.” But then at footnote 2, page 8 of their opinion, the Oregon decision states, “he attested to witnessing Varner’s signature.” No attestation was made by myself and no such statement was made by myself regarding any “attested“ signature.
The complete and entire discussion regarding notarizing is as follows;
The Board examiner stated, “That’s a big issue (if the client’s signature is not notarized) that (issue) can very easily go away at least as far as I’m concerned for my recommendation to the rest of the Board will be if I can see the agreement itself.

That was the only question and the only answer regarding notarization. There was no discussion regarding attestation and the use of the word “attestation“ or “attesting“ or any other such word was never said. If a further question was asked of me I would have truthfully answered that as well, just as I answered all of their questions truthfully, fully and without omission.
Allegation 3
You lied to the Oregon Board in your application by stating there was a reversal of a $34,000 (?) against you for malicious prosecution in California. They state you indicated it was reversed on the merits and the matter was actually reversed by stipulation.
Response:
I did not lie to the Oregon Board. The question on the application at 13 (p) Have you…ever been sanctioned…as a member of any profession…as a result of your conduct.” I truthfully answered “Yes.” In the attachment I stated,
“I was sanctioned by the trial court for bringing an action against Alan Michel in the Bernath v. Santa Monica Bar Association matter. The Court of Appeal for the Second Circuit of California reversed the trial court.
This response is true. Respondents in the underlying action withdrew their motion for sanctions. The respondents then filed with the Court of Appeals a notice that the matter had been reversed pursuant to. Neary v. The Regents of the University of California et al. 3 Cal. 4th 273, 834 P2d 119, 125, after a global agreement between the parties. Respondents stated it was “in the interests of justice.“
I answered truthfully and without any omission on my Oregon Bar Application and I thereafter answered all questions truthfully, fully and without omission to the Oregon Board on January 20, 1995 as well.
Bernath: So basically we settled that way. His (my attorney’s) insurance company paid me and that money went to those people and I away sadder but wiser.
Committee Member: Is that this Michel, Primack and Cerny?
Bernath: Yes.
Committee Member: That’s the litigation?
Bernath: Yes.
Committee Member: That’s what I wasn’t clear about that. So they got a judgment for like $35,000 and on appeal you resolved that by transferring over the $12,000 you got from Schulze’s insurance company to them is that?
Bernath: Yes. Basically that’s it. That resolved everything.
The Supreme Court of California has stated that a reversal in the Court of Appeals to reverse a trial court’s findings upon agreement that the trial court’s decision was in error is a reversal on the merits and that was the understanding of all parties. Neary v. The Regents of the University of California et al. 3 Cal. 4th 273, 834 P2d 119, 125.
If the respondents did not agree to file for a reversal with the Court of Appeal stating in effect that the trial court erred, I would not have agreed to end the litigation as I was confident, as were my attorneys, that it would be reversed by the Court of Appeal. While a 1999 amendment to California law might require a different procedure, clearly the law at the time I stated that there was a “reversal” in 1994 was totally correct.
Furthermore, hiding nothing, I went to great lengths to inform the Oregon Board of any and all detail regarding the reversal as can be seen by the lengthy explanation to the Oregon Board in my application for Oregon Bar membership and the oral explanation to the Board when they met with me later on.
Allegation 4 On May 16, 1997, you issued subpoenas holding yourself out to be an attorney licensed in Oregon.
Response:
The California State Bar has investigated this matter and has already determined that it lacked merit and did not pursue it. (complaint 97 0 14496 attachment) The statement in the Oregon opinion, as the others, is simply false. I did not sign, nor issue a subpoena duces tecum stating that I was an active member of the California Bar or of the Oregon Bar.
I telephoned from Tigard (Portland) Oregon the licensed copy service Associated Reproduction Services in California to serve a SDT on a California law firm, in California in a lawsuit where I was a party and representing myself. They asked me questions regarding who was to be served and the items to be sought.
They sent me a work order. (attached) On this work order in my handwriting, dated 5.13.97, I clearly stating that I am Bernath, Esq. and that the records, once obtained by the SDT should be delivered to me: “ Bernath“.
Again, I was acting in my own defense and representing nobody in that matter.
This request was memorialized in a letter back to me from Associated Reproductions (attached) There, I clearly am named only as Daniel Bernath, Esq. Again, I was acting on my own behalf and not acting as an attorney for any party. I signed no subpoena duces tecum as an attorney or at all in any fashion and issued no such SDT. The licensed copy service sent out the SDT from their computer and I did not see it until it arrived with the requested records at my address.

Fired Schneider-Hired Bernath
I never met with or spoke with attorney Merrill Schneider. I saw his advertisement on the television and he said “Free Consultation.” He can’t charge me now for what his advertisement then said was “free.”
I set up an appointment with my friend R and myself to meet with Merrill Schneider. We met at his office and met with Nicole Schneider. I was with her for 30 minutes-the free consultation he advertises. I never heard from Nicole Schneider or Merrill Schneider, again. I never heard from anyone at his office. I called him at least once a month. They were always never in the office. The receptionist said, “can I have your name and number and they’ll call you back” but no one ever called me back and I called them once a month.
I hired Schneider so that he would look into my case. When I first met with Nicole and I told her that Victims Services of Oregon paid me for a whole year and she said, “then your case is a slam dunk.” I thought that he and she would then do an OTR-that is, get the case decided in my favor without me having to wait for a hearing because it was so obvious that I was disabled. That’s what Nicole Schneider said-it was a “slam dunk.:”
I believed he and she would work on that but they did nothing and my case just sat on his shelf. I now find that he did not obtain any of my medical records and it appears to be negligence that they did not get me my benefits by just getting my medical records and showing them to a judge (an OTR) without making me wait for a hearing. When I fired Schneider and I said I wanted my medical records, he replied that he didn’t have ANY medical records. So all that time I thought he was working on my case but it was just sitting on a shelf collecting dust at his office.
When I hired Dan Bernath as my lawyer, I noticed a big difference. I spoke with Bernath all the time, he kept me informed about everything. He answered his phone personally and didn’t use a secretary or receptionist to hide behind. Bernath got me a hearing in five months. Schneider did not send me any letters to tell me what was going on filing papers, how to get things done, how to prepare- he didn’t send me squat.
Bernath did real good in preparing the case for trial. I got paperwork on how to get medical records, how the whole disability thing works at Social Security court, how I can best testify to show the judge my condition and had many discussions with Bernath on strategy, how to handle myself at the hearing and what was expected to win benefits.
I knew I didn’t have to worry because Bernath was working on my behalf day after day. I really was impressed at how attorney Bernath pulled every detail of my medical problems out of me in testimony. Bernath said at the hearing that “Judge Jones runs a tight ship” and still I watched Bernath get it all on the record, quickly and professionally. When I got emotional at one point in the hearing or when I didn’t quite answer a question, Bernath was very good at politely and quickly getting me back on track.
Bernath did a very good job in cross examining the vocational expert in that the last thing said in the hearing was that I was disabled and could not work. I thought that was a good thing that Bernath did that in having the vocational expert say that as the last thing said at the hearing for the judge to hear.
Attorney Bernath has changed my life.

Hey, I recorded a program on Friday, later when my sons and I watched the
program there "You" were on TV in a Social Security Commercial... you are so
handsome! woohoo! LOL
I know am shameless, I had to flirt a little. Even my sons
were impressed, both said they could tell you were pretty sharp! We all agree on
your choice of suits, really works for you Mr. Bernath.
I first called Merrill Schneider because of his t.v. commercial but decided to hire Daniel Bernath instead. Merrill Schneider and his law office people seem so flaky and rude and disorganized. you do all the work yourself. I tried to call Merrill Schneider several times but never got through to him!
