Hyatt v. Social Security Commissioner Astrue

At all times, the plaintiff was an administrative law judge hearing Social Security cases.

A Merit Pension Board complaint against Dan R. Hyatt was released by a federal employee, using a fax machine inthe office of an employee of the Social Security Administration.

As a direct and proximate result of the wrongful release of the MSPB complaint, said complaint was republished on Daniel (A.) Bernath's website www.oregonshyster.com (click here for complaint that you REALLY shouldn't be reading.  Hyatt has his rights to privacy, ya know) and in the Oregonian newspaper with a circulation in excess of 250,000.  Copies of this MSPB complaint were published online at www.oregonshyster.com and also published on the front page of the Oregonian newspaper.

A Federal Tort Claim Notice was timely submitted, but no action has been taken on this notice.

(at the time Hyatt attacked Daniel A. Bernath, Hyatt) was acting within the course and scope of his duties as an Administrative Law Judge...

Hyatt suffered physicial injury, mental pain and suffering, and emotional distress.

Due to SSA's violation of the Privacy Act of 1974, Dan R. Hyatt was subject to unfavorable publicity which adversely affected his career and personal life.  Dan R. Hyatt suffered mental pain and suffering and emotional distress.
