In October 2007, when I entered the massively large courtroom I immediately saw the large bronze seal that was behind Dan R. Hyatt that said

I thought that my hearing for Social Security disability benefits were being heard by a United States District Court Judge. Dan R. Hyatt was wearing a black robe and I was sure that he was a full blown judge and not just a SS judge. At no time did Dan R. Hyatt tell me that he was only an Administrative Law Judge employed by Social Security. I know that real judges are appointed by the President of the United States and confirmed by the United States Senate after long exhaustive hearings and I was impressed that a US District Court judge was hearing my case.


I saw sitting very high up behind a blond platform. He looked very angry.


He said, “Do you have a lawyer?


I said, “I don’t have one.”


then said, “I’m going to continue your case. I’m going to rule against you if you don’t have a lawyer.” “If you show up without representation I will rule against you.” or words to that effect. A tape was made so you can hear his exact words.


I then called Daniel Alan Bernath and retained him as my attorney. I wondered how a US District Court judge, like Dan R. Hyatt could act so un-judgelike with his threats and his anger and mentioned that to attorney Bernath. Mr. Bernath explained his true status to me that is really just a Social Security employee and his job is administrative law judge and he is not a United States District Court Judge.


Mr. Bernath also told me that made a statement that showed “extra-judicial bias”. I understood that before Mr. Bernath said that. I have a right to not be represented by a lawyer or be represented by a lawyer. It has nothing to do with the fact that I am disabled and that Social Security can only look at those facts and not pick some other reason to deny me my disability benefits.


I thought that if my case was already being heard by a US District Court judge like Dan R. Hyatt that there was no reason to appeal to the US District Court if I disagreed with Dan R. Hyatt ’s ruling. This misrepresentation confused me and would have caused me to lose my right to appeal Dan R. Hyatt ’s rulings to US District Court.
