My attorney has not only dragged out my case but he also missed filing a deadline.
I had an incident with the City of Portland Police on April 6, 1999. Apparently they were watching the car in which I was driving, when I left the hotel where I had earlier that night dropped off a couple of friends to stay, the police followed me. When I saw the lights behind me, I pulled off the road not knowing at the time they were pulling me over. When I pulled into the parking lot, I then realized they were pulling me over. I had come to a complete stop and was reaching for my wallet in my back pocket for my I.D.; the police car rear ended the car in which I was driving. Apparently when the police exited their car, they did not put it in park, therefore rear ending me. When the police officer came up on the car he asked me for my license, I gave it to him, he went back to the police car and then returned to the car I was driving and asked that I step out of the car. I asked him why, he said again, step out of the car. I got ready to step out, reached over and turned around, pushed up on the seat ready to get out. As soon as I got ready to make that move, that’s when two police officers snatched me out of the car. When they yanked on me, I grabbed onto the console and they yanked on me again. One of the officers stated he could have blown my brains out, I told them I had nothing to hide. They asked if they could search the car, I told them go ahead I had nothing to hide. From the time they pulled me out, until the time they released me, I kept screaming about my back and shoulder killing me. If they were watching the car and could see it from where they were sitting, then they could see the person getting into the car. The person they were looking for was 25 years younger than I was, weighed 40-50 pounds less than I did, shorter than I am, and a lot darker than I am.
I was seen at the emergency room of Woodland Park Hospital the next day, due to the pain I was having between my shoulder blades, neck, right arm and fingers, due to the manhandling by the police officers earlier that morning.
I wrote a letter to the City putting them on notice that I had obtained a lawyer and was going ahead with the claim.
Cedric Brown was representing me. He was only going after the city for the rear end, which we got approximately $500.00 for the damage to the car. But I also put the City on Notice for a claim on the manhandling by the police officers, which Mr. Brown wasn’t pursuing, so I decided to let him go and find another attorney. Papers were filed with the court in June of 2000.
After seeing my doctor, Dr. Ordonez, I found out I had to have back surgery in June of 2000, a surgery Dr. Ordonez said I couldn’t wait to have. Since the case with the city was still pending, and they wouldn’t pay for the surgery, I was told by a Mr. Snyder that we could list it as “On the Board” so that Workers Comp would pay for the surgery and could recoup their money from the City when the case was settled, so that’s what we did.
The city attorney, Mary Danford took my deposition in February 2001, at a time when I was between attorneys. At the time of this deposition, she offered me $6000.00 to settle this case, I said no, that didn’t even cover my medical bills. Depositions were also taken by the City Attorney, Mary Danford, from Officers, Richard Paul Braskett and Randy Scott Teig in July 2001. To this date, the fourth officer’s deposition has never been taken. Depositions were also taken from the two women in the motel room from which I left, just before the incident with the police.
I then acquired my current attorney Gino Pieretti in September of 2001. I meet with him, we went over the case I explained my side of the story; he concluded we had a case. He went over the file and made his notes, I took him down to where I worked and he talked with people I had previously worked with and nothing much has been done since. The case was set to go to arbitration, but never did. The Statue of Limitations has now run out and the City has washed their hands of it. Brenda Agee and I met with Gino in February of 2009; this is the 1st meeting I have had with him in quite sometime. As Gino admitted, nothings been done on this case from August 2002 to February 2009. He had to go down into the basement to pull my file out and to the court to get some other papers he realized he didn’t have. I, my attorney and Brenda just now in July 2009 sat down and went over my deposition given back in 2001 only to find out there are discrepancies in it. Every time I called him I had to leave a message, then he would get back to me and give me an excuse as to why he couldn’t do this or do that, illness in the family, another case, mine just kept being pushed to the back burner. Gino has now gotten in touch with his insurance company and my case has been handed off to another attorney appointed by his insurance company by the name of Janet Scheoer to find out where we go from here.
I am hereby filing an official complaint against Gino Pieretti for negligence in my case.
The court gave Gino 90 days to review my case; he talked with me about what had happened, took depositions from my witnesses, went to my job and talked with my supervisor and co-workers, and then revisited the scene of the incident. He said I had a case and he would represent me. I signed papers for him to obtain any and all my records that he may need in addition to what he got from Cedric Brown.
My case has never had any precedence put on it what so ever since this time.
Three to four years into my case I confronted him about a statue of limitations on my case and he said there was none since we had already filed for arbitration, the statue of limitations no longer applied.
Then in February of 2009 when Brenda Agee and I met with him he had to get my file from his records in the basement, he had once again put it aside, on the back burner, then claimed he couldn’t find the letter where I filed the suit against the city and if we didn’t have that, then we had no case. I knew it was in the file, because if it wasn’t then he wouldn’t have taken my case to begin with. It took him 2-4 weeks just to find the letter in my file and get back to me.
Then when we met again he had his law book out regarding the statue of limitation, but said he thought that didn’t matter in my case, since we were set to go to arbitration, but would check into it further. When I asked him why my case had gone past the statue of limitations he couldn’t tell me, his only response was he didn’t know, but if he was negligent in anyway, then I would be compensated by his insurance company, that every practicing attorney had to have insurance just for this reason, to protect their clients.
We have never discussed what I was actually suing the city for, what I thought I was entitled too; this is when he looked up in yet another book and told me it would be around $100,000.00, that’s what they were paying in the year of my incident. My question was what is that amount for, pain and suffering, medical bills, time loss from work, what?? He didn’t give me an answer. It’s now been ten years, what about the stress I’ve been under with this case still pending after ten years.
Gino said he would contact Mary Danford at the city to recommend we still go to arbitration, she said she would pull the file, but had moved to another department, but would look at it and pass it on to the appropriate person. When Gino talked to her again, she said the case had past the statue of limitations, but would check with her supervisor. Then she was out of the office for surgery, so here again we sit in limbo once again.
Then he was going to check with his insurance company on had to proceed. Now I understand it has been sent onto another attorney through his insurance company and she has gone through the file and says we should still go to arbitration and had her law firm checking into it and would contact Mary Danford who is out of the office once again and now here we sit again.
Mary Danford has put us on notice and given us deadlines to meet, why aren’t we doing the same to city. Why do I have to continue to sit here and wait, it’s been ten years.
Where do I go from here???????????????????
