I am writing to report improper conduct by attorney Merrill Schneider. Almost two years ago, I called for a lawyer referral and was given Merrill Schneider - Hooton. With my first appointment with the firm, my case was assigned to Mr. Gary Johnson. A year later he left the firm and my case was assigned to Merrill Schneider.

Thirteen months later, a paralegal of Merrill Schneider’s law firm named Kevin Morton left a message on my answering machine stating the statute of limitations was coming up on my case and to call Merrill Schneider back as soon as possible. I did speak to him via phone.

Merrill Schneider told me that he wasn’t pursuing my case any further , that the defendant was someone he knew professionally, and since he was a former district attorney, his word against mine in court wasn’t something he chose to pursue, etc.

I told Merrill Schneider that I wanted him to pursue a settlement and he said he would call me back in a couple days. In the interim I spoke

with other lawyers, out-of-state within my family and all have suggested that this sudden revelation of a conflict of interest of knowing the defendant, thirteen months after being transferred the case, was unacceptable.

I am asking for the State Bar’s help in finding another attorney to peruse my case file and possibly take my case before the statue of limitations runs out on my case. Or, if you have other suggestions, I would like to hear them.

I am hoping that my second attorney referral will have proper conduct, no negative transference, nor procrastination tendencies and would provide me with excellent representation. Please respond at your earliest convenience.

As discussed with you briefly by phone yesterday, I want my case to be filed as a complaint before the statue of limitations runs out. Your paralegal, Kevin, informed me of such for the first time yesterday, as well.

I am also letting you know that your sudden telling me yesterday, that you personally know the defendant, “he’s an ex-district attorney”, was a

surprise. I think it would have professionally appropriate to notify your client of such when we first met after you transferred my case. Thus, now I do not have as much confidence of your objectivity to handle my case zealously within the bounds of law with this defendant.
