now read in the Bar's Formal Opinion No. 2005-151 (4) that "A lawyer may not
charge more than the agreed-on fee, and any fee charged in excess of the
agreed-on fee is excessive as a matter of law." Laura A. Schroeder This Oregon lawyer committed malpractice.

After a period of fourteen months and $200,000. in attorney fees , I concluded a "fixed fee agreement" with Attorney Laura A. Schroeder (Bar #873392) to complete my case through trial for a fixed fee of $55,860.50 , which was scheduled in about six weeks.
I went to my credit union and borrowed the money, which Schroeder was kept informed as to the progress of the loan. I initially paid $10,000. of the $55, 860. fee.
Less than a month before trial, Schroeder came to me and demanded an additional $20,000 to the already request $55,860 fee to complete the case. This would have made the total cost of around $75,000. to the already fee of $200,000.
I
now read in the Bar's Formal Opinion No. 2005-151 (4) that "A lawyer may not
charge more than the agreed-on fee, and any fee charged in excess of the
agreed-on fee is excessive as a matter of law."
Trial Exhibit #19 was marked as the "fixed fee budget" ($55,860.50) and received into evidence by the trial court. Strangely, when the jury requested to see the "fixed fee agreement" during deliberations, it was "missing".
Trial Judge Alicia Fuchs commented as to the request from the jury, "So--it is puzzling to me how that happened because I can't imagine that if I knew it was admitted, I would not have given it to them. So that is an issue that's kind of up in the air in my mind,. But I agree there's no clear answer to that." The jury never got to see "exhibit #19".
On the last day of trial , Schroeder was seen going through the jury books and removing various documents from those books. This was just prior to deliberations. There is no other excuse, since the "fixed fee agreement" was in the jury books prior to this time. The "fixed fee agreement" was admitted into evidence.
Typically, the Oregon Bar ignores the Formal Opinions as to any enforcement action, so it is puzzling why they even have them?
Laura A. Schroeder has overbilled me.

facts:
I signed a written contract with Laura Schroeder wherein the agreed upon
billing rate
for senior paralegals was to be $75.00 per hour. Thereafter the billing
statements
reflected a rate of $95.00 for senior paralegals. Ms Schroeder changed the
contractual
rate without notification or my consent to do so. Ms Schroeder has
admitted that she
intentionally
over billed from the stated contractual rate and that she did not consult
with me or obtain my consent to do so.
The total amount billed for this contractual change was in excess of
$22,000. over a 15
month period of time.
Ms Schroeder has acknowledged the overbilling but refuses to refund any monies.
Ms Schroeder has previously been sanctioned for overbilling other clients.
